1. Acceptance of Terms

By accessing or using Spark Learn ("the Service") at spark-learn.app, or through our iOS or Android apps, you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Spark Learn is an educational platform designed to support children's learning in Key Stage 1 and early Key Stage 2, including:

• Maths worksheet generation
• Spelling practice and testing
• Phonics learning activities
• Reading book logging
• Progress tracking for parents

3. User Accounts

Account Creation

You must create an account to use Spark Learn. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Be at least 18 years old (or the age of majority in your jurisdiction)
• Be responsible for all activities under your account

Child Profiles

Child profiles are created and managed by parent/guardian accounts. By creating a child profile, you confirm that you are the parent or legal guardian of the child, or have appropriate authority to create such a profile. Children do not create their own accounts and should only use the Service under parental supervision.

4. Subscriptions and Payments

Subscription Tiers

Spark Learn offers the following subscription tiers:

• Free: Limited access including basic maths topics, up to 3 spelling lists, Phase 2 phonics, and 1 child profile.
• Spark Pro: Full access to all features, unlimited worksheets, all phonics phases, AI sentence generation, and 1 child profile.
• Spark Pro Family: Everything in Spark Pro plus up to 6 child profiles.

Billing and Renewal

Paid subscriptions are billed on a monthly or annual basis, depending on the plan you choose. Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date.

• Prices are displayed in your local currency at the time of purchase
• We may change subscription prices with at least 30 days' notice
• Price changes take effect at the start of the next billing period after notice

Payment Processing

Payments are processed through the platform from which you subscribed:

• Apple App Store: Governed by Apple's Licensed Application End User License Agreement
• Google Play: Governed by Google Play's Terms of Service
• Web (Stripe): Processed securely via Stripe. We do not store your payment card details.

Cancellation

You may cancel your subscription at any time:

• iOS: Via Settings > Apple ID > Subscriptions on your device
• Android: Via Google Play Store > Subscriptions
• Web: Via the subscription management page in Settings

After cancellation, you retain access to paid features until the end of the current billing period. Your account then reverts to the Free tier. Your data is not deleted upon cancellation.

Refunds

Refund policies are governed by the platform through which you subscribed:

• Apple: Refunds are handled by Apple. Request a refund at reportaproblem.apple.com
• Google: Refunds are handled by Google Play. Request within 48 hours of purchase via the Play Store.
• Web: Contact us at support@spark-learn.app within 14 days of purchase for a full refund if you are unsatisfied with the Service.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Share your account credentials with others
• Attempt to gain unauthorised access to any part of the Service
• Interfere with or disrupt the Service
• Use automated means to access the Service without permission
• Upload malicious content or code

6. Content and Intellectual Property

Our Content

All educational content, worksheets, and materials provided by Spark Learn are owned by us and protected by copyright. You may use these materials for personal, educational purposes only.

Your Content

You retain ownership of content you create (such as word lists and book logs). By using the Service, you grant us permission to store and process this content to provide the Service.

AI-Generated Content

The Service uses artificial intelligence (Anthropic's Claude) to generate example sentences for spelling words. This AI-generated content:

• Is provided as a learning aid and may occasionally contain inaccuracies
• Should be reviewed by parents before use with children
• Is generated on-demand and cached for performance
• Does not constitute professional educational advice

7. Multi-Parent Sharing

The Service allows parents to share access to child profiles with other parents or guardians. When you share access to a child profile:

• You confirm you have authority to share such access
• Shared users will have access to the child's learning data
• You can revoke shared access at any time

8. Service Availability

We strive to maintain Service availability but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will endeavour to provide reasonable notice before making significant changes that affect your use of the Service.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind. We do not warrant that:

• The Service will meet your specific requirements
• The Service will be error-free or uninterrupted
• Educational content will achieve specific learning outcomes
• AI-generated content will be accurate in all cases

Spark Learn is a supplementary educational tool and is not a replacement for school-based education or professional educational support.

10. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim arising from or relating to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Termination

You may terminate your account at any time via the Settings page. We may suspend or terminate your account if you violate these Terms. Upon termination:

• Your right to access the Service will cease
• Any active subscriptions should be cancelled separately through the relevant app store or payment platform
• We will delete your data in accordance with our Privacy Policy

12. Age Requirements

You must be at least 18 years old to create an account. The educational content is designed for children aged 4-11, but children should only use the Service under parental or guardian supervision. We do not allow children to create accounts or use the Service independently.

13. Changes to Terms

We may modify these Terms at any time. We will notify you of significant changes by posting on the website, through in-app notification, or by sending an email. Continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree with the updated Terms, you should stop using the Service and cancel your subscription.

14. Governing Law

These Terms shall be governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer in the European Union or United Kingdom, nothing in these Terms affects your statutory consumer rights.
